Welcome to SportsKaki.com, the Asian Sports Buddy network. SportsKaki facilitates sports enthusiasts and people to break the ice and get together to play their favourite sport and increase their business or social networks. The SportsKaki network is operated by SportsKaki.com.

By using the SportsKaki.com web site (the "Web site") you agree to be bound by these Terms of Service (this "Agreement"). If you wish to become a Member and communicate with other Members and make use of the SportsKaki™ service (the "Service"), read these user Terms and conditions of Service and indicate your acceptance of them by following the instructions in the registration page. In addition, by using or accessing the Services described below, persons doing so will also be indicating their agreement to be bound by the terms and conditions.

DEFINITIONS & INTERPRETATION

Except where the context otherwise requires, any reference in these terms and conditions to:

* "User or Visitor" means any person using the Services offered on or any person accessing the SportsKaki.com Web Site;

* "Member" means any person using the Services offered on or any person accessing the SportsKaki.com Web Site whilst subscribing to selected or gated sections on a registration or pay-for-use entry to SportsKaki.com services;

* "Electronic Record" means a record generated, communicated, received or stored by electronic, magnetic, optical or other means in an information system or for transmission from one information system to another;

* "Person(s)" includes entities, companies, corporation(s) and un-incorporated bodies of persons;

* "SportsKaki's Web Page" means any web page which is comprised in the Service Provider's Web Site and which bears the same domain name as that of the Service Provider's Web Site;

* "Service Provider's Web Site" means the web site maintained operated or owned by SportsKaki.com , which home page is accessible at the internet URL known as "http://www.sportskaki.com" and which bears the domain name known as "SportsKaki.com" or such other website or location as may be designated by the Service Provider from time to time;

* "Services" means the various services to be provided by SportsKaki, subject to these Conditions and reference to "Services" includes a reference to any part thereof;

* "These Conditions" means these conditions relating to the provision of the Services as varied or supplemented from time to time;

* Words importing the singular shall include the plural and vice versa and words importing one gender shall include any other gender; clause headings are for ease of reference only and shall not affect the interpretation hereof; references to clauses are to the clauses of these Conditions;

* A reference to "day" shall be a reference to a day determined in accordance with Singapore time and any references to time in these Conditions shall be a reference to Singapore time

In the event that these Conditions are translated to another language, these Conditions set out herein in the English language shall prevail over any such translation

SERVICES

The provision of the following services to the Customer: The provision of information via the Service Provider's Web Site, the Service Provider's Web Pages and any other services which are ancillary to such provision of information; Such other services which the Service Provider may provide to the Customer on the Service Provider's Web Site and Service Provider's Web Pages, through the use of electronic records, via the Internet or other electronic networks or services shall be conditional on the Customer's acceptance of and compliance with these Conditions.

The Services are owned and operated by the Service Provider and is provided to the Customer subject to these Conditions and any operating rules or policies that may be published by the Service Provider from time to time Some Services may only be accessed by the Member through the use of the Customer's verification code, passwords, personal identification numbers (PINs), account numbers, user IDs and/or other personal or other security information selected or notified by the Service Provider to the Customer for this purpose from time to time (the "Security Information").

The Member is aware that any instructions or messages that are sent by the Member to SportsKaki through the use of electronic records, via the Internet, or other electronic networks or services shall be given only in accordance with the security requirements, procedures or devices (including the use of the Security Information) stipulated by SportsKaki from time to time (collectively the "Security Procedures").

The Member further agrees that there will be an irrefutable presumption that any instructions or messages received by SportsKaki through such means, purporting to be given by the Member, is actually given by the Member and the Member shall be bound by and be responsible and liable for all consequences relating thereto, as if such instructions or messages had been given by the Member.

The member may need to access the SportsKaki.com services as a paid subscriber in order to participate and/or access the various services provided in the SportsKaki.com website.

These fees and charges are given at the point of registration for which the member have used the several options to transact payments through. Subscriptions may not be assigned or transferred to any other person or entity.

Apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password, the Member must promptly inform SportsKaki.com Pte Ltd. The SportsKaki content is available only via subscription ("Subscription Service") but SportsKaki does not guarantee that the availability of the SportsKaki Content will remain available as a Subscription Service.

SportsKaki reserves the right to alter the Subscription Service and to alter the types of services offered on the SportsKaki website and to charge a fee for offering them or to offer them free-of-charge. Sportskaki will try to process your subscription promptly but does not guarantee that the Subscription Service will be available to you by any specified time. A contract with you for receipt of the Subscription Service will come into effect when Sportskaki sends you an email confirming your subscription.

Sportskaki reserves the right to suspend or terminate your subscription to the Subscription Service if you breach these terms and conditions, with or without notice and without further obligation to you. Sportskaki will charge you in Singapore Dollars and any applicable taxes shall be payable by you.

There will be no refund nor rebate if a subscription is cancelled or terminated early in the absence of any fundamental breach by SportsKaki of these terms and conditions.

INFORMATION

In consideration of being permitted to utilise the Services, the Member agrees to provide current, complete, and accurate information about themselves (the "Personal Data") when requested by Sportskaki. If any information provided by a Member is incomplete or inaccurate, SportsKaki retains the right to terminate the Member's rights to use the Services and such termination shall not affect any rights of SportsKaki.

Member's Security Information shall not be known or disclosed to any party except SportsKaki and its employees, agents, servants and contractors, strictly on a “need-to-know” basis. However, the Company shall be entitled to disclose the Security Information to any third party if required to do so by any law, regulation or court order. Members shall:-

* be solely responsible for maintaining the confidentiality of the Security Information;

* shall immediately notify SportsKaki of any theft or unauthorized use of Member's Security Information or any other breach of security;

* log out of Member's browser at the end of each of session on the SportsKaki's Web Site, so as to ensure that others cannot access Member's Security Information, personal information and correspondence;

* not disclose Member's Security Information to any third party; SportsKaki shall in no way whatsoever be liable to Member for any loss, damage, costs, expense incurred by Member as a result of, arising out of or in connection with the wrongful or fraudulent use of Member's Security Information, whether by Member or any third party.

Member shall not acquire any rights, title, interests over the Security Information agree that SportsKaki shall be entitled (in its sole discretion) to terminate the use of the same at any time whatsoever, without being required to assign any reason. Upon such termination, Member shall no longer be entitled to use or access the Security Information and SportsKaki may deactivate or delete the Security Information and delete all related information and files.

SportsKaki shall not be liable to Member or any third party for any termination of the Security Information. This Agreement will remain in full force and effect while you use the Web site and/or are a Member. Members may terminate the membership at any time, for any reason by writing in to contactus@sportskaki.com.

SportsKaki may terminate the membership for any reason, at any time. If SportsKaki terminates any customer’s membership in the Service because of breach the Agreement; the customer will not be entitled to any refund of unused subscription fees. Even after membership is terminated, this Agreement will remain in effect.

Passwords and compiled names, photos, links, and Web site content are not to be transferred or copied from the Web site for use with any other product or service. Illegal and/or unauthorised uses of the Web site, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Web site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress. SportsKaki owns and retains all proprietary rights in the Web site and the Service. The Web site contains the copyrighted material, including links and compilations of individual data, trademarks, and other proprietary information of SportsKaki, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Content Posted on the Site. You understand and agree that SportsKaki may review and delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of SportsKaki violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members.

Your profile must describe you, an individual person. Examples of inappropriate profiles include, but are not limited to, profiles that purport to represent an animal, place, inanimate object, fictional character, or real individual who is not you. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service, or transmit to other Members.

By posting Content to any public area of SportsKaki, you automatically grant, and you represent and warrant that you have the right to grant, to SportsKaki an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

The following is a partial list of the kind of Content that is illegal or prohibited on the Web site. SportsKaki reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. It includes Content that:

* is patently offensive to the online community, such as Content that promotes racism, bigotry , hatred or physical harm of any kind against any group or individual;

* harasses or advocates harassment of another person;

* involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming"; promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

* promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

* contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;

* displays pornographic or sexually explicit material of any kind;

* provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

* provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

* solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and

* engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes Even though all of this is strictly prohibited, there is a small chance that you might become exposed to such items and you further waive your right to any damages (from any party) related to such exposure.

You must use the Service in a manner consistent with any and all applicable laws and regulations. You may not include in your Member profile any telephone numbers, street addresses, last names, URLs or email addresses. You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members.

Although SportsKaki cannot monitor the conduct of its Members off the Web site, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

In order to protect our Members from such advertising or solicitation, SportsKaki reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which SportsKaki deems appropriate in its sole discretion.

Member Disputes

- You are solely responsible for your interactions with other SportsKaki Members. SportsKaki reserves the right, but has no obligation, to monitor disputes between you and other Members. The activities covered in SportsKaki can and do include sport activities that are physical in nature.

These do carry significant risk of personal injury or even death. SportsKaki, including its writers, photographers and other staff and management does not recommend that anyone participate in these sports unless they are medically fit or have no current or prior injury/ies.

SportsKaki advises all members of SportsKaki and users of SportsKaki to seek medical advice before proceeding to play their sport. Activities that our users participate do so at their own risk. SportsKaki will not be responsible for any injury, personal injury or death in the event of their participated / participating activity. All materials, information, products & services included on SportsKaki, are provided "AS IS", with no warranties whatsoever.

SportsKaki expressly disclaims to the fullest extent permitted by law all express, implied, and statutory warranties. SportsKaki disclaims any warranties for services or goods received through or advertised on SportsKaki.
